Terms of Service
Last updated: October 18, 2026
Acceptance and Eligibility
You must be at least 13 years old to use ThumbConnect. If you are under 18 (or under the age of majority in your jurisdiction), you may use the services only with the consent and supervision of a parent or legal guardian who agrees to these Terms. By using the services, you represent and warrant that (a) you meet these requirements, (b) all information you provide is accurate and current, and (c) if you are using the services on behalf of a business or other entity, you are authorized to bind that entity to these Terms. The services are intended for users in the United States, and we make no representation that they are available or appropriate for use outside the United States.
Accounts and Registration
You do not need to register to use parts of ThumbConnect; you may participate with an auto-assigned nickname. To reserve a custom nickname, you register it with an email address for recovery. You agree to provide accurate and current information and to keep it updated. Your account is held in a cookie on your device; you are responsible for keeping your device and cookie safe and for all activity under your identity. You agree to notify us promptly of any unauthorized use of your account.
The Service
ThumbConnect is a public square - one shared place to play games, ask questions, share items, connect with people, and run discussion boards. It has five cards: Play, Ask, Share, Connect, and Discuss.
ThumbConnect connects people. It does not judge quality, handle money, or arrange transactions. Any arrangement you make with another user - borrowing, giving, selling, meeting up - is between you and that person, at your own risk.
User Content
"User Content" means any content you submit to the services, including text, images, posts, replies, listings, responses, board content, and votes. You retain ownership of your User Content. You grant ThumbConnect a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (for formatting), display, and distribute your User Content as necessary to operate, provide, and improve the services. You represent that you own or have the necessary rights to your User Content and that it does not violate any law or third-party right. You are solely responsible for your User Content.
Prohibited Conduct
You agree not to: use the services for any unlawful, fraudulent, or harmful purpose; post false, misleading, infringing, defamatory, harassing, or obscene content; misrepresent your identity or affiliation; scrape, harvest, or collect other users' information; interfere with, disrupt, or attempt to gain unauthorized access to the services or their security; use the services to send spam, flood, or run automated scripts that disrupt the square; or violate any applicable law or the rights of any third party.
Moderation and Enforcement
Moderation is local by default. Each discussion board is run by the person who created it; that person can remove topics and replies and ban nicknames from their own board only.
ThumbConnect itself enforces a technical floor: rate limits, duplicate detection, and other measures against automated abuse. We reserve the right to act - including removing content or suspending or disabling access - for serious platform-wide violations such as illegal content or a compromised board.
Account Deletion
Account Deletion and Public Contributions
When you delete your account, ThumbConnect removes your registered email address and disables access to that account. Your chosen nickname may be retained alongside your previous public posts, replies, and discussions to preserve conversation history and continuity. Your nickname will be marked "No longer participating" and cannot be reassigned to another user.
Private information is handled separately according to our Privacy Policy.
Deleting an account ends your participation; it does not necessarily erase the history of your public interactions. Disclosing this policy does not override any applicable privacy or deletion rights.
Platform Disclaimer
ThumbConnect (operated by TaygaNet, LLC) is a connection platform only. We are not a party to, and do not supervise, guarantee, or insure, any arrangement made between users. We are not responsible for the quality, safety, legality, or completion of anything arranged through the platform. All arrangements are strictly between the users involved. You accept all risks associated with interacting with another user.
Copyright / DMCA
We respect intellectual property rights and respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act (DMCA). If you believe content on the services infringes your copyright, send a notice with the information required by 17 U.S.C. § 512(c)(3) to our designated agent: DMCA Agent, TaygaNet, LLC, 204 Evers Way, Denton, TX 76207, email [email protected]. We may remove allegedly infringing content and terminate repeat infringers' access to the services.
Disclaimer of Warranties
The services are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. ThumbConnect does not warrant that the services will be uninterrupted, secure, or error-free, or that any content or interaction will meet your expectations. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
Limitation of Liability
To the fullest extent permitted by law, TaygaNet, LLC and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, or goodwill, or any property damage or personal injury arising from or related to any interaction or arrangement between users, even if advised of the possibility. ThumbConnect's total aggregate liability for all claims relating to the services will not exceed the greater of (a) the total amounts you paid ThumbConnect in the twelve (12) months before the event giving rise to the claim, or (b) one hundred dollars ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. In such jurisdictions, liability is limited to the maximum extent permitted by applicable law.
Indemnification
You agree to indemnify, defend, and hold harmless TaygaNet, LLC and its officers, members, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the services, (b) your User Content, (c) your violation of these Terms, (d) your violation of any law or third-party right, or (e) any interaction or dispute between you and another user.
Termination
You may stop using the services at any time. ThumbConnect may suspend or terminate your access at any time, with or without notice, including for violation of these Terms. Upon termination, the rights granted to you will cease, and you may lose access to your account. Termination does not entitle you to a refund. The sections titled User Content, Moderation and Enforcement, Platform Disclaimer, Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Dispute Resolution, Governing Law, and General survive termination.
Intellectual Property
The ThumbConnect platform, including all software code, design, text, graphics, logos, icons, and the selection and arrangement thereof, is the exclusive property of TaygaNet, LLC and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, display, perform, publish, license, create derivative works from, transfer, sell, or otherwise exploit the platform or any of its content without prior written permission from TaygaNet, LLC. "ThumbConnect" is a trademark of TaygaNet, LLC.
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. To the extent any dispute is not subject to arbitration under the Dispute Resolution section below, you and ThumbConnect consent to the exclusive jurisdiction of the state and federal courts located in Dallas County, Texas.
Dispute Resolution; Binding Arbitration; Class-Action Waiver
You and ThumbConnect agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the services through final and binding individual arbitration, rather than in court.
- Informal resolution. Before starting arbitration, you agree to first contact us at [email protected] and give us 30 days to try to resolve the dispute informally.
- Arbitration rules. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (including the Consumer Due Process Protocol) by a single arbitrator, and may be conducted by phone, video, or written submissions. The Federal Arbitration Act governs the interpretation and enforcement of this section. If AAA is unavailable or unwilling to administer the arbitration consistent with these Terms, the parties will agree on a substitute administrator, or a court of competent jurisdiction may appoint one.
- Class-action waiver. You and ThumbConnect agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims.
- 30-day right to opt out. You may opt out of this arbitration agreement within 30 days after you first accept these Terms by sending written notice of your decision to opt out to [email protected], including your name and account information. If you opt out, neither party can require the other to arbitrate, and this section will not apply to you.
- Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive or equitable relief in court for actual or threatened infringement or misuse of intellectual property. If the class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will proceed in court.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice, such as by posting the updated Terms with a new "Last updated" date. Your continued use of the services after the changes take effect constitutes your acceptance of the revised Terms.
General
These Terms, together with our Privacy Policy, are the entire agreement between you and ThumbConnect regarding the services and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver of that or any other provision. You may not assign these Terms or your account without our consent; we may assign these Terms to an affiliate or successor in connection with a merger, acquisition, or sale of assets. Nothing in these Terms creates any partnership, employment, agency, or joint-venture relationship between you and ThumbConnect.
